Terms of Service

These Terms of Service (“Terms”) govern use of Nexova Reach, a product of Techzex Software Pvt. Ltd. (“Company”, “we”, “us”). By accessing our website or logging into the platform, you agree to these Terms.

2. The service

Nexova Reach provides multi-tenant tools for bulk email, WhatsApp messaging (and SMS when enabled), including templates, lists, campaigns, reports, and administrative controls. Features and limits depend on the plan assigned by Super Admin.

3. Accounts

• You must provide accurate registration information and keep credentials confidential.
• You are responsible for all activity under your account.
• We may suspend accounts for non-payment, abuse, or policy violations.

4. Acceptable use

You agree not to use Nexova Reach to:

• Send spam, phishing, or unsolicited messages in violation of applicable law
• Violate WhatsApp / Meta, email ISP, or telecom regulations
• Upload unlawful, harmful, or infringing content
• Attempt to breach security or misuse another tenant’s data

You are solely responsible for obtaining consent from recipients and for the accuracy of contact lists you import.

5. Fees and plans

Pricing for email, WhatsApp, and related services is as quoted or configured by Super Admin for your tenant. Published website prices are indicative and may change. Taxes (including GST) may apply as per Indian law.

6. Third-party services

Delivery may depend on your SMTP provider, Meta WhatsApp Business API, and other carriers. We are not liable for outages or policy enforcement by those third parties.

7. Intellectual property

The Nexova Reach software, branding, and site content belong to Techzex Software Pvt. Ltd. You retain ownership of content you upload, and grant us a licence to process it solely to provide the service.

8. Disclaimer

The service is provided “as is”. To the maximum extent permitted by law, we disclaim warranties of uninterrupted or error-free operation. Delivery rates depend on recipient networks and third-party policies.

9. Limitation of liability

To the maximum extent permitted by law, Techzex Software Pvt. Ltd. shall not be liable for indirect, incidental, or consequential damages. Our aggregate liability for any claim relating to the service shall not exceed fees paid by you to us for the service in the three (3) months preceding the claim.

10. Termination

Either party may terminate the subscription as per the commercial agreement. Upon termination, access may be revoked and data retained or deleted as described in our Privacy Policy.

11. Governing law

These Terms are governed by the laws of India. Courts at Bhubaneswar, Odisha shall have exclusive jurisdiction, subject to applicable law.
